Part of a series of classroom aids designed for real estate instructors, this instructional packet was developed to help real estate students understand public and private easements, which most commonly entail the right of a person (or the public) to use the land of another in a certain manner. Following an evaluation form for the packet, a summary presentation is provided covering the various types of public and private easements, how they are formed, and how they can terminate. The presentation is keyed to a series of handouts and overhead masters covering: (1) what is an easement; (2) what is a license; (3) categories of easements; (4) importance of private easements; (5) caveat on private easements; (6) in gross and appurtenant easements; (7) estates in and classifications of appurtenant easements; (8) affirmative and negative easements; (9) ways easements may arise without written expression; (10) exceptions to written requirements; (11) creating implied easements; (12) easement by estoppel; (13) basic requirements for prescriptive easements; (14) qualifications for tacking; (15) ways easements may be terminated; (16) types of private and public easements; (17) creation of public easements by statutory or common law dedication, prescription, or condemnation; (18) elements of common law dedication; (19) acceptance of dedicated public easements; (20) legal restraints on and enablement of condemnation; (21) court decisions; and (22) Texas law concerning statutory dedication of urban and rural areas. A total of 33 overhead masters are included in this packet. (AYC)
