Understanding Tort Liability and Its Relationship to Extension Professionals.
Long, Norman D.; And Others
This study focuses on tort liability and its relationship to extension professionals working with 4-H programs. Tort liability as related to extension professionals consists of ten components: due care, physical defects (inspection of premises), instruction and supervision, first aid and medical treatment, foreseeability, causation, defamation, assault and battery, contributory negligence, and notice of claim (statute of limitations). As public officials, extension professionals are subject to state statutes for tort liability. The Indiana statutes listed were chosen as an example and are indicative of the complexity and serious nature of tort law in other states. Sections of the paper are devoted to legal terms and definitions, legal aspects of 4-H programs, case studies related to 4-H, and insurance for accidents and injury. (Author/IRT)
