An Update on the Biden Administration's Higher Education Agenda

Since taking office, the Biden administration has sought to advance a complex and ambitious higher education regulatory agenda. The U.S. Department of Education held two separate rounds of negotiated rulemaking in 2021-22 to rewrite rules governing student loan relief programs and institutional accountability. This fall, the agency announced plans to convene a negotiated rulemaking committee to draft a new pathway to student debt relief and is also poised to launch another major round of rulemaking focused on accreditation, distance education, state authorization, third-party servicers, and a number of other topics. The latest moves suggest that the White House and department plan to move aggressively to continue to influence postsecondary education in the second half of President Biden's term. However, limited resources and competing priorities could impact the Department of Education's ability to finalize and implement the entire slate of potential new rules ahead of next year's presidential election. This articles provides an update on: (1) student loan and institutional accountability rules; (2) student loan debt relief rules; and (3) institutional quality and accountability rules.
