The American community college has posed, for a period of time, some distinctively unique concerns pertaining to legal issues. However, the most pressing legal issues facing community colleges now are those regarding personnel. The diversity of programs community colleges offer require that personnel (specifically faculty) come to the institution with a wide variety of educational backgrounds, experiences, and training. Nationally, community colleges are in the throes of turnover in all areas of employment. Much has been written regarding turnover in the administrative ranks of these institutions. However, a greater number of professional and faculty employees will enter the community college in the near future, and a large percentage of these new employees will have little or no knowledge of the purpose and mission of the American community college. In this article, the author discusses legal concerns in community college employment. The author points out that community college administration, trustees, and legal counsel must address these issues before they are forced to enter the judicial system because of an employee's legal action against the college.
