The trend toward more litigation and higher monetary awards in cases of injury of student athletes is a threat to school athletic programs. This document is a workshop aid for addressing legal issues surrounding student athletic activities, in particular, those involving the safety and health of student athletes, injury prevention, and preparation for litigation should injury occur. A quick comparison is given between preparation for a game and for a lawsuit: the steps are identical. Legal definitions and concepts; transparency samples; an outline of a school's legal duties with respect to statutory, common, and case law; and case histories are provided. Practical methods are also presented in overhead format. Sample materials are offered, including a liability-loss-control assessment, athletic-orientation checklist, acknowledgements of warning by parents and by student, warning of the inherent danger of participating in football, athletic-meeting notification to parents, parental delegation of authority to consent to medical or dental treatment for minor child, college athletic-safety policy statement, and gymnastics-safety guidelines. Also included are a hazard-recognition/area-safety self-inspection format, self-inspection program-implementation outline, and safety checklists for activity and play areas where injuries might occur.
