Collaboration in Search of a School Funding Remedy Post DeRolph

March 24, 2007, marked a decade since the Ohio Supreme Court first ruled that the state school funding system was unconstitutional. Further, "DeRolph I" was followed by three more Ohio State Supreme Court decisions regarding the issue. Although the judicial decisions of "DeRolph I and II", reinforced by "DeRolph IV", clearly identified the legal principles emanating from the case and left no doubt that the responsibility for the education of public school-age pupils rested primarily with the state legislature, the mandates of the court have not been fulfilled. The issues pertaining to the creation of a "thorough and efficient" system of education have not been resolved. Further, in "DeRolph IV" the court relinquished its jurisdiction over the case without a remedy. The purpose of this article is to provide an update regarding the post-"DeRolph" period and the progress that may have occurred since "DeRolph" with respect to school funding reform. The collaborative efforts of a broad-based coalition formed to seek consensus on a constitutional amendment will be examined. Considerable emphasis will be given to the purpose of the amendment to develop a process to determine the content and cost of an adequate education. Analysis of the development of the amendment in the context of the current political climate will be included. Finally, the impact of the election of the first Democratic governor in 16 years will be discussed. (Contains 72 footnotes.)
