For decades, postsecondary institutions have focused more on the line between compliance and noncompliance, balancing the rights and responsibilities of institutions with those of students with disabilities. The danger for postsecondary institutions in focusing on a "line in the sand" approach was to further perceptions that students with disabilities were getting something others were not (accommodations), thus setting up unnecessary tensions. A new era is dawning, however, led by amendments to the Americans with Disabilities Act (ADA) itself, revised regulations, the influence of technology, and new populations on campus (those with autism spectrum disorders and U.S. military veterans) that will make faculty, staff, and administrators stretch beyond their traditional comfort zones in pursuit of equal access to postsecondary education. This chapter highlights key features in the upcoming dialogue and touches on issues that will be coming to the fore by discussing statutory and regulatory amendments, court cases, and letters of finding issued by the U.S. Department of Education's Office of Civil Rights (OCR). Since the ADA and section 504 are substantially the same as they apply to higher education, this chapter generally refers to either the ADA or section 504 of the Rehabilitation Action of 1973 (section 504).
