The Commonwealth of Kentucky was identified in the Adams v Richardson case as one of the nineteen states that were cited for providing separate but equal education for black and white students in higher education. The Office of Civil Rights (OCR) required the state of Kentucky to develop a voluntary desegregation plan for its state institutions to meet the requirements of Title VI of the Civil Rights Act of 1964. The Kentucky Plan for Equal Opportunity in Postsecondary Education was the result. Education, race, policy, and politics are all facets of "The Kentucky Plan." The purpose of this study was to examine how the administration of "The Kentucky Plan" played an integral role in the effectiveness of the plan and its duration while highlighting each of the facets of the plan. The three major components used in the methodology of the study are a chronological analysis, interviews of the stakeholders responsible for the administration of The Kentucky Plan, and an analysis of the annual reviews and system reports. Senate Bill 398 (KRS 164.020(19) was enacted by the 1992 Kentucky General Assembly which is fundamental to the enforcement of The Kentucky Plan is also detailed in the study. Unique aspects of the study are the approach taken by the researcher to detail the administration of the plan, giving the plan a voice through the interviews of eleven stakeholders, and how the information derived from the study of the administration of the plan and a scholar activist approach can be used in developing equity policies for underrepresented populations in public postsecondary institutions. In conclusion the major findings of the study are The Kentucky Plan has been effective in eliminating the vestiges of a de jure education system, the administration of the plan impacted its effectiveness, duration, and there's still more to be done. Furthermore, there axe intersectional relationships which exist between law, educational policies, politics, and leadership at every level of the plan and communication enhances the effectiveness of the administration of the plan.
