This article describes in detail the Tian Yong v. University of Science and Technology, Beijing case. Plaintiff Tian Yong sued University of Science and Technology for refusing to issue him certificates of graduation and degree. Tian Yong believed that he had met all the criteria to be considered a legally qualified college graduate and that it is illegal for the university to refuse to grant him a graduation certificate. Upon review of Tian Yong's case, the People's Court discovered that Tian Yong was accused of cheating by his school during an examination. Tian Yong went to the bathroom in the middle of an exam and on his way, a paper, which contains examination materials, fell out of his pocket. The university ordered Tian Yong to withdraw, but it failed to deliver the change of student status to him. Tian Yong continued to participate in normal learning and other school-organized activities as a student of the university. Because of that incident, the university has refused to grant Tian Yong a certificate of graduation and degree certificate. The court decided that the university should issue Tian Yong a certificate of graduation because its refusal to do so was invalid. Although Tian Yong did violate exam rules at the university, it did not harm his reputation as a student. [Translated by Huiping Iler.]
