Advertising and Invasion of Privacy.

The right of privacy as it relates to advertising and the use of a person's name or likeness is discussed in this paper. After an introduction that traces some of the history of invasion of privacy in court decisions, the paper examines cases involving issues such as public figures and newsworthy items, right of privacy waived, right of privacy precluded by consent, limits of consent, termination of employment, revocation, malice, sufficiency of identification, incidental use of name, and who may bring action against whom. A second section of the paper discusses usage of name or likeness as an invasion of privacy as it relates to endorsement of products or services, usage of name on a product, and recovery allowed and denied. A section is included on use of pictures for display purposes, in newspapers or other printed publications, in television or motion pictures, and mistaken use of pictures. A final section discusses usage of name or likeness in false light including misrepresenting of authorship or statements and alteration of pictures. Each section includes numerous references to court decisions. (TJ)
