This document examines some of the questions concerning copyright law and the educational use of equipment that can easily duplicate, store, and transmit instructional materials. It is argued that a delicate balance must be achieved between protection for copyright holders and access for educational purposes to audiovisual works, music, computer technologies, and printed works. The discussion includes the following topics: (1) contract law; (2) videotaping, video rental, and closed-circuit television; (3) library reproduction; (4) computer software, database downloading, and telefacsimile (FAX); (5) licensing agreements; and (6) copyright policy development. Several illustrations of fair use of copyrighted materials are provided, as well as guidelines for classroom photocopying, software use, use of music, and recording broadcast programming for educational purposes.
