Disproportionate representation of children from diverse racial and ethnic backgrounds in special education has been a longstanding concern that the 2004 reauthorization of the Individuals with Disabilities Education Act (IDEA) sought to address. The IDEA contains new requirements related to the provision of early intervening services designed to assist students who are not identified as having a disability, but "who need additional academic and behavioral support to succeed in a general education environment" [Section 613(f) of the IDEA]. The purpose of this document is to share information about the status of implementation regarding the related requirement that local education agencies (LEAs) reserve 15% of their IDEA funds to address significant disproportionality [Section 618(d)(2)(B) of the IDEA]. This document is a report of interviews with state personnel abut the implementation of this provision. (Contains 5 footnotes.)
