The ways in which parents and students can exercise their rights under the Family Educational Rights and Privacy Act are discussed in this booklet. The Act, also known as the Buckley Amendment, gives all parents and guardians of students under 18 years of age and all students who are over 18 or who attend postsecondary schools the right to see, correct, and control access to student records. The records specified in this regard are only those which are "personally identifiable" (in other words, records that contain the student's name, social security number, student identification number, or other data that make them traceable to the student). Under the provisions of the law, schools are required to establish written procedures to carry out the rights this law establishes, and the Department of Education is required to see that they do. Procedures for gaining and controlling access to records and for making corrections in them are specified. Also indicated are procedures to follow if schools refuse access to records or release information without the student's consent.
