"Kelo v. City of New London": An Ideal Case to Teach Ethical and Legal Principles

In June 2005, the U.S. Supreme Court rendered a decision that caused much concern and anxiety across America. "Kelo v. City of New London" was viewed by many as an egregious violation of the Takings Clause of the U.S. Constitution. In "Kelo", the majority upheld a state statute that supported the use of eminent domain for purposes of economic development in situations where private property was conferred from one private party to another. From the time this case was decided, it received much media attention. Because of the high profile of this case, its personal appeal, and the numerous substantive areas of law prevalent in its evolution, it serves as a perfect case for introducing the study of business law to graduate business students. This article briefly summarizes the "Kelo" case and its majority opinion, addresses why it is an "ideal case" for teaching nonlaw graduate business students, and establishes an approach for using "Kelo" to introduce the legal principles typically covered in a graduate business law course.
