In this appeal from the United States District Court for the District of South Dakota, Kathleen Sullivan is the appellant; Meade Independent School District, No. 101, school board members, and school administrators, the appellees. The single, young elementary school teacher was discharged at midterm by the small, rural community's school board as incompetent to teach because she shared her dwelling in the school community with a single man. She charged the dismissal violated her rights to privacy, freedom of association, and substantive due process and equal protection of the laws. The appellate court affirmed the district court's dismissal of action against all appellees. Since the right of a couple to live together outside of matrimony had not been held to fall under the right of privacy, the court further ruled that the board had not violated that "constitutional right." On the primary question of due process violation, the appellate court said the board acted in good faith and with concern for the teacher's constitutional rights, and could not be held liable for damages. Judge of the district court was Andrew Bogue; judges for the Eighth Circuit Court of Appeals were Heaney, Bright, and Webster. (RS)
