This manual is intended for individuals who agree to act as educational surrogate parents for children with disabilities in North Dakota. Section 1 provides an overview of the educational surrogate parent service, including surrogate parent qualifications, protections, responsibilities, confidentiality, and the surrogate's partnership with the school. An overview of special education is presented next in a review of the history of special education and special education laws and policies, including North Dakota special education regulations, the Individuals with Disabilities Education Act (IDEA), the Family Education Rights and Privacy Act, Section 504 of the Rehabilitation Act of 1973, and the Americans with Disabilities Act of 1990. Section 3 explains the educational surrogate parent's role in the special education process. Subsections cover determination of services, the building level support team, referral, the multidisciplinary team, the assessment planning process, the individualized education program, the least restrictive environment, implementation, and annual review. School communications and meetings are addressed in Section 4, which offers guidance on methods of communicating, preparing for a meeting, and resolving differences with the school.
