To spell out, as Michael Krauss does here, the University of Michigan's contorted reasoning behind its successful bid to discriminate by race in the name of diversity is to expose the logical shambles of the "Grutter" decision. Not only does the ruling smack of incompetence, but Professor Krauss cites procedural shenanigans in the 6th Circuit that betray its weakness in legal ethics as well. (Contains 10 notes.)
