Implementation of the Americans with Disabilities Act has been complicated by uncertainty about the fundamental nature of various activities, goods, or services and about what constitutes competence or qualification in people who are excluded from them. Discusses how the courts can ascertain the fundamental nature of conventional activities when determining reasonable accommodation, reflecting on values that may be protected by the fundamental nature exception of the law.
