Weaknesses in the court ruling in EEOC v. Missouri Pacific Railroad and its implications are examined. This case stands for the proposition that once a private party files an action in federal court based on a charge of discrimination filed with the EEOC, the EEOC is relegated to seeking permissive intervention.
