Bona Fide Seniority Systems and Relief from "Last Hired, First Fired" Layoffs Under Title VII

The history of the exemption for bona fide seniority systems under Title VII is explored briefly. It is suggested that the courts can provide protection for incumbent workers potentially disadvantaged, which may mean substantial monetary liability for employers using "last hired, first fired" layoff systems.
