"Open to All": Title IX at Thirty.

In June 2002 the U.S. Secretary of Education established the Secretary's Commission on Opportunities in Athletics. The purpose of the 15-member Commission was to collect information, analyze issues, and obtain broad public input directed at improving the application of current federal standards for measuring equal opportunity for men and women and boys and girls to participate in athletics under Title IX of the Education Amendments of 1972. The Commission held six public meetings to address the questions posed by the Secretary of Education about Title IX and the Department of Education's enforcement standards. Testimony from more than 50 expert witnesses and public comment from parents, athletes, and administrators of elementary and secondary schools, colleges, and universities were supported by document reviews to develop 23 key recommendations to ensure equal opportunities in athletics. These 23 recommendations, 15 of which were approved unanimously by Commission members, can be grouped into four thematic categories: (1) commitment; (2) clarity; (3) fairness; and (4) enforcement. The Commission recognizes that some of its recommendations will require additional research, including study of how Title IX relates to other debates in postsecondary education over accountability, cost, governance, and quality. It is clear that Title IX enforcement requires reform in order to make the law more clear, fair, and enforceable, and truly open to all.
