IDEA 1997: Implications for Secondary Education and Transition Services. Policy Update: Summarizing Recent Laws and Federal Regulations.

In 1997, the Individuals with Disabilities Education Act (IDEA) was reauthorized and new regulations took effect May 11, 1999. Several sections of the regulations pertain to the transition of students with disabilities from school to adult life. This policy update presents the regulatory language and describes potential implications in 11 areas relating to transition. The areas include: (1) the purposes section, which emphasizes the need to prepare students with disabilities for employment and independent living; (2) the definitions section, which describes transition services to be provided; (3) a section which provides an exception to the requirement to provide a free appropriate public education for some students of transition age; (4) a section which addresses the possible ineligibility of students in adult prisons; (5) a section which requires student participation in state and district-wide assessments; (6) a section which requires students to be invited to attend Individualized Education Program (IEP) meetings if transition services will be considered; (7) the parent notification section; (8) the agency notification and participation section; (9) a section detailing the content of the IEP, including transition services; (10) a section outlining agency responsibilities; and (11) a section addressing the transfer of parental rights.
