This document is designed to provide information to North Carolina administrators and teachers on policy issues related to students with disabilities. Policy letters from the U.S. Office of Special Education Programs and the Office of Civil Rights, as well as "Analysis of Comments and Changes" and "Notice of Interpretations on IEPs" of the Federal Register, are the sources of the questions and answers selected to be included in the document. Questions and answers address the following issues: (1) placement, including screening, evaluation, and identification, placement procedures, the Individualized Education Program (IEP), related services, reevaluation, change in placement, transfer students, and free appropriate public education provisions; (2) procedural safeguards, including prior notice, due process, independent educational evaluations, attorney's feeds, surrogate parents, confidentiality, and destruction of records provisions; (3) discipline, including suspensions, physical restraint, and use of aversive provisions; (4) financial responsibility, including use of funds, residential schools, third-party payments, headcount, and responsibility and liability provisions; (5) general education requirements, including state testing programs and graduation requirements provisions; and (6) preschool children with disabilities, including screening, evaluation and identification, placement procedures, IEPs, related services, reevaluation, free appropriate public education, procedural safeguards, use of funds, and responsibility and liability provisions.
