Diverting Public Funds: The Misguided Mission of the Independent Living Center of Amsterdam, Inc.
New York State Commission on Quality of Care for the Mentally Disabled, Albany.
This report presents findings of an investigation by the New York State Commission on Quality of Care for the Mentally Disabled into the programmatic and financial practices of the Independent Living Center of Amsterdam (ILC/A), a New York institution which receives two-thirds of its monies from Medicaid to provide services to individuals with developmental disabilities. Specifically, the investigation found that the ILC/A: (1) illegally used Medicaid and state contract monies to fund a retirement community corporation (Veddersburg Village), which it then mismanaged; (2) exceeded its corporate authority in developing Veddersberg and violated the State Education Law, which bars housing programs; (3) misled state contract agencies by assuring them that no government monies would be used to develop Veddersburg, while overcharging a state contract for $58,000; (4) solicited "donations" from consumers transported by its vehicles, despite receiving public funds to pay for such transportation, in violation of law; and (5) received over $45,000 in Family Support Service contract funds for services to underserved individuals with developmental disabilities, despite having no such clients. The report begins with an overview of the Independent Living Centers, offers background information, and then reports Commission findings concerning Veddersburg Village, agency transportation services, Project Lead, agency cost allegations, program review, and regulatory implications. Recommendations and responses by the New York State Office of Vocational and Educational Services for Individuals with Disabilities are also included. Attachments include relevant letters. (DB)
