Cable, The First Amendment, and the Future: A Time To Change Course.

Addressing the issues of the application of the First Amendment and deregulation, this paper examines the judicial and legislative precedents for cable television regulation and the current industry status. The paper then addresses the questions: (1) Should and could a different regulatory approach be taken? (2) What types of models might best be followed? and (3) How would a different approach withstand the First Amendment scrutiny that led the cable industry to where it is today? The paper specifically examines the common carrier/public utility and state/municipal ownership models of regulation. The paper concludes that the application of the First Amendment and deregulation have gone too far and will not produce a system that goes to the heart of preserving minority views and generally serving the public's best interest.
