Seeking Flexibility in School Management: Waivers and School-Based Program Coordination under AB 777.
Pacheco, David R.; And Others
The two papers in this document focus on two different major educational reforms and their continuing central issues in California's comprehensive school finance legislation of 1981. The first report, "The Waiver Process for California's Educational Code," by David R. Pacheco, examines the legislation that delegated to nonelected board members the ability to waive a broad array of Education Code elections. This authority created little concern when passed partly because the legislature excluded various key sections of the Education Code, including state provisions for school funding, employee layoff and discipline procedures, and controversial categorical programs. The second study, "Documentation of Model Programs for Implementation of Assembly Bill 777 (School-Based Program Coordination Act)," by Public Policy Research, Inc. addresses reform for increased school district administrative flexibility involving several categorical education programs. In contrast to waiver authority legislation, these reforms met opposition primarily over allowance of funds for special needs to be used for other purposes. Various waiver issues continue to be legislative topics, while implementation of the School-Based Coordination Act has been the concern of the State Department of Education, local school districts, and county educational offices.
