Sexual Harassment in Employment. Investigator's Guidebook.

This manual is intended to aid in the investigation of sexual harassment complaints by providing information specifically addressing special considerations and the analysis of sexual harassment complaints in the employment context. Although primary focus is the investigation and analyses of cases in the State civil service, the principles of investigation and the analyses of cases are applicable to any governmental jurisdiction and to employment in the private sector. Chapter 1 is an introduction. Chapter 2 discusses conducting an investigation. Topics include the investigator's role, a definition of and special considerations regarding sexual harassment, steps in conducting an investigation, determining jurisdiction, organizing the investigative file, limiting the scope of inquiry, conducting a thorough investigation, and writing the report. Chapter 3 concerns the analysis of sexual harassment cases. It defines harassment and provides legal standards for the two basic categories of sexual harassment: work environment and conditional. A case analysis compendium is presented and remedies are listed. Chapter 4 gives a brief overview of major factors to consider in conducting an investigation of sexual harassment allegations. It offers discussions of (1) types, sources, and evaluation of evidence; (2) determining the amount of evidence necessary; and (3) basics of interviewing. Relevant guidelines and codes are appended.
