Legal Responsibility of Educators in Child Abuse.

This chapter explores the legal responsibilities of educators concerning the problem of child abuse. The first section provides a legal definition of child abuse as behavior of a parent or guardian that (1) inflicts serious physical injury on a child by nonaccidental means; (2) creates a substantial risk of such injury; or (3) commits or allows a sex offense against the child. Section 2 examines statutory requirements providing for teacher and administrator responsibility, and section 3 highlights issues of liability for mandated reporting and for failure to report suspected child abuse. The chapter concludes with a list of identifying characteristics of abused children and suggests guidelines for school districts to consider in confronting the issue. (TE)
