Association of Governing Boards of Universities and Colleges
The need for college trustees and administrators to develop better procedures and management techniques to minimize potential liability to lawsuits is addressed. A trend for seeking judicial relief on campuses and suits filed against deans, trustees, and presidents, as well as the school, are noted. Trustees need to be informed about new requirements defined by the courts and by legislation. Federal requirements are reviewed with respect to nondiscrimination, tax-exempt status, and collective bargaining; state legislation affecting institutions; constitutional requirements applied to state institutions; contractual obligations; potential liability in tort litigation; and special problems of church-related colleges. Legal responsibilities of trustees and some specific preventive measures, including participation in college goal-setting, are considered. (SW)
