Advertising and Defamation of Character.

Defamation of character, as applied to libel and slander legal decisions, is the subject of this paper. After briefly describing the basis of liability, the author discusses "libels per quod." He then cites numerous court decisions in commenting on mitigating circumstances in action for libel or slander, including absolute privilege, fair comment, matters of public interest, the effect of being a public figure, good faith, reliance on government information, and lack of malicious intent. In discussing retraction as a defense, the author indicates that retraction does not eliminate liability but may reduce penalties. He cites and discusses several cases relating to defamation by radio, television, and cable television. In an extensive concluding section, the author considers cases and points referred to elsewhere in the paper and adds more case illustrations in describing the parameters of defamation of character in legal decisions in cases of libel and slander.
