Legal Problems in the Solicitation and Administration of Private Donor Funds in Higher Education.

A topical overview of the solicitation and administration of private financial support for institutions of higher Education is presented, with particular attention to associated legal problems, both actual and potential. Contextual considerations discussed include the role of private donor funds in both private and public higher education and general legal considerations such as the distinction between "trusts" and "gifts" and the "publicness" of a trust or gift. Legal problems in solicitation are described, including those related to corporate giving, the difference between subscriptions and requests with respect to collection, restrictions on contributions, state and federal regulation of solicitation, and "special" legal problems in solicitation. A discussion of legal problems in the administration or use of private financial support provides information on donor restriction, altering the conditions and restrictions of gifts and bequests, institutional trustee management responsibilities, and other administrative concerns, such as misappropriations of restricted funds, internal administrative procedures, emerging forms of private giving and donation "plans," and certain matters of legal ethics.
