A Description and Analysis of H.R. 10891 and H.R. 10931: Bills Reorganizing and Amending Title I of the Elementary and Secondary Education Act.
Silverstein, Robert; And Others
Section 821 of the Education Amendments of 1974 directed the National Institute of Education (NIE) to conduct a study of compensatory education, including those programs financed under Title I. NIE then contracted with the Legal Standards Project of the Lawyers' Committee for Civil Rights under Law to conduct a two year study of the basis for and the clarity and restrictiveness of the legal framework of Title I. Under Task I, the Project reorganized the Title I statute to achieve greater clarity, consistency, and coherence without making any substantive changes in the existing law. Under Task II, contracted through an extension of the initial study, the Project reviewed its own and other contractors' findings. It then prepared statutory language entailing changes in the existing statute and language for inclusion in the legislative history of Title I. This document includes: (l) the Task I draft reorganization of the statute; (2) memoranda concerning the reorganization; (3) Task II Statutory Amendments to Title I, integrated into the Task I material (H.R. 10891 and H.R. 10931 are based on this section of the document); and (4) a discussion of each recommendation, including a statement of the existing legal framework, major findings, the proposed statutory amendments, and proposed language for inclusion in the legislative history.
