This chapter deals with cases on the allocation of authority and responsibility within the educational structure of the several states, as well as with cases arising out of contractual obligations and other sources of legal rights. School board members, administrators, and teachers need to understand their legal rights and responsibilities if they are to function effectively and with the least exposure to personal liability and damages for their errors and omissions. The first section deals with Supreme Court decisions in the areas of hearings for dismissed teachers, state sovereignty, retirement, and residence requirements for employees. Other sections deal with the authority and responsibility of state and local boards of education, board meetings and minutes, bidding and contracts, and school district and board member elections.
