The Buckley/Pell Amendment: Its Implications.
Kilpatrick, Ronald N.
Student records may be deemed quasi-public. They are public because some are required by law to be maintained by public officials; they are private because of the highly personal and sensitive subject matter sometimes contained in them. The Buckley Amendment was created with the idea of standardizing the framework in which universities and school systems handle student records. The amendment requires that 11 affected institutions afford either parents of students under 18 years of age or an 18-year-old student the following rights--to inspect and review the educational record kept by the school system; to challenge or request the removal or modification of material felt to be inaccurate, misleading, or inappropriate; to limit the number and type of individuals who will be able to see a student's record; to receive a list of those individuals who have been permitted to see a student's record; to be notified every time a student's records are turned over to a court by judicial order or subpoena; and to be informed of the provisions of the act. A model policy on student records is proposed. (Author/IRT)
