Privacy Rights of Parents and Students.

This portion of the "Federal Register" states the proposed requirements of section 438 of the General Education Provisions Act. This section deals with the privacy rights of parents and students. The statute provides parents of students with access to official records directly related to the students and with an opportunity for a hearing to challenge such records on the grounds that they are inaccurate, misleading, or otherwise inappropriate. Institutions must obtain the written consent of parents before releasing personally identifiable data about students to other than a specified list of exceptions. Further, parents and students must be notified that these rights exist, that these rights transfer to the students at certain points, and that an office and review board must be established in the Department of Health, Education, and Welfare to investigate and adjudicate violations of and complaints about this statute.
