Prepared by the District of Columbia Street Law Project for its 21 annual city-wide mock trial competition, this instructional handout provides material for a mock rape trial. David Jones and Susan Williams, both students at Capital University, had dated on and off during the previous years and on the night of the incident had attended a party together. Susan returned with David to his apartment, and they engaged in sexual intercourse. Susan claims that David raped her; David claims that Susan had consented. The handout explains the relevant laws and includes excerpts from precedents that clarify the law. As evidence, the handout provides the police incident report and witness statements from Susan, a rape counselor, a detective, David, a friend of David's, and David's psychologist. Through participation in mock trials and analysis of the activity, students gain an insider's perspective on courtroom procedure and a basic understanding of the legal mechanism through which society resolves its disputes. Mock trials develop critical analysis, questioning and listening skills, and skills in preparing and organizing materials. (JD)
