Cases involving employment interests of teachers, administrators, and other school employees generally continue trends set in earlier years. Discrimination considerations continue to play an important role. One area in which the courts might be said to intervene somewhat more than in others is the prevention and remediation of race discrimination. Courts have been quick to defend the rights of black employees both in districts under desegregation orders and in other cases, such as the case mandating more hiring of minorities in a St. Louis suburban system. Despite the amount of legislation regulating sex discrimination, relatively few cases reached the courts during the past year. One of the most significant opinions was the decision by the supreme court of Indiana invalidating the adoption of separate actuarial tables for the computation of benefits of male and female retired teachers. Other traditional areas of concern receiving attention are employee dismissal and discipline, tenure and seniority, and questions of substantive and procedural due process. (Author/IRT)
