Kitzmiller v. Dover: A Public Policy Analysis

The Intelligent Design Movement has attempted to infuse Intelligent Design into the curriculum of public schools ever since the Edwards decision, which ruled that "creation science" was a violation of the the "Establishment Clause. Kitzmiller v. Dover" was the first legal case to challenge the teaching of Intelligent Design in public schools. In "Kitzmiller", Judge Jones ruled that Intelligent Design was not science and therefore, the only legitimate purpose of the Dover County School Board was to advance religion. Judge Jones based his decision on a "belt-and -suspenders" approach using both the "Lemon Test" and the "Endorsement Test" in his decision. The purpose of this study was to chronicle the history of "Establishment Clause" litigation leading up to "Kitzmiller". It was also to examine the literature surrounding Intelligent Design and the Intelligent Design movement. Finally, this study examines the landmark case of "Kitzmiller v. Dover" to show the process of how Judge Jones arrived at his decision. This study also tried to offer recommendations whereby Intelligent Design might be taught in a public school setting as well as follow-ups for future research.
