College that Requires Workers to Be Christians Allowed to Post Job Ads on Pennsylvania Web Site

Geneva College, a Christian institution in Pennsylvania, will be allowed to post job advertisements on a state-sponsored Web site even though the college requires employees to be Christians, according to the terms of a settlement reached in federal court. The college had sued the Pennsylvania Department of Labor and Industry and the U.S. Department of Labor after it was forbidden to post jobs on Pennsylvania CareerLink, a state-sponsored employment Web site that receives some federal funds. Pennsylvania officials had argued that because the college discriminated on the basis of religion in hiring, its job postings were in violation of the federal Workforce Investment Act. However, according to the settlement, Pennsylvania officials now concede that that argument does not apply to Geneva because the college does not receive funds from the Workforce Investment Act. That federal law provides money for retraining workers who are laid off from their jobs. It remains unclear whether a religious institution that did receive money from the Workforce Investment Act could post job ads on the site.
