An Investigation of Demographic and Academic Factors as Predictors of Disproportionate Discretionary In-School Suspensions of Black High School Students

School districts were faced with numerous lawsuits for violating students' due process rights in the early 1980's. In response, schools began using other disciplinary responses to discipline violators such as in-school suspension (Adams 2000; Hanson 2005). In-school suspension provided a softer and less punitive approach to discipline and allowed for students judged to be unruly to stay in school and receive instruction yet be isolated from the rest of the student population. Existing research discusses Black learners being identified in the literature as the population of learners who have consistently been referred for disciplinary actions in disproportionate amounts to their enrollment in Texas public schools (Fabelo, et. al., 2011). The purpose of this study was to determine if demographic and academic factors predict disproportionate discretionary in-school suspension (ISS) occurrences of Black high school students. More specifically, this study was concerned with the predictability of district size, number of disciplinary placements, number of Black students passing the fifth grade TAKS mathematics test and the number of students retained in fifth grade on disproportionate discretionary ISS occurrences of Black high school students. The study included a total of 101 school districts from Regions 4, 6 and 13 that met the minimum size requirements to report Black students academic and discipline data on the AEIS and PEIMS reports. Multiple regressions were used to determine the statistically significant relationship between demographic factors and disproportionate discretionary ISS occurrences of Black high school students in school districts in Texas ESC Region 4, 6 and 13. The findings indicated that there is a statistically significant relationship between the demographic predictors' size of the school district and disciplinary placements with disproportionate discretionary ISS occurrences of Black high school students. There is also a statistically significant relationship between the academic predictors fifth grade TAKS mathematics scores and students retained in fifth grade.
