This Bud's for You: Understanding International Intellectual Property Law through the Ongoing Dispute over the Budweiser Trademark
Bird, Robert C.
Journal of Legal Studies Education, v23 n1 p53-85 Mar 2006
There is little doubt that topics related to beer would be of some interest to college students. Anheuser-Busch, well known for its Budweiser beer and humorous advertising, faces a global trademark challenge to its "Budweiser" name. This battle between a global American company and a small Czech brewery is an opportunity for interesting instruction in an undergraduate or graduate business law course. This article examines the dispute between Anheuser-Busch and Budejovicky Budvar over the ownership of the trademark term "Budweiser." The first section describes the history and development of this world-famous struggle. The second section examines the current national and international trademark law relevant to the parties in this dispute. The third section explores the teaching opportunities that arise from this interesting and topical conflict. This dispute can introduce students to trademark law, explain the various international approaches to trademark law, and allow instructors to contrast national trademark protections. This dispute also shows how differing national cultural viewpoints impact the nature and enforcement of intellectual property law abroad. (Contains 154 footnotes.)
