Different images come to mind when thinking about college fraternities and sororities, depending on who you are. Whether your images are positive or negative, one thing is constant: You envision a group of same-sex young people. But one of the major social issues that this country is dealing with is the treatment of transgender people, and arguably the higher education institutions (HEIs) are pioneering the way. One question that HEIs are tackling more frequently is whether there is a place for transgender students in Greek life. Title IX bars colleges and universities from discriminating on the basis of sex. However, there is a carve-out for fraternities and sororities, meaning fraternities that allow only men as members and sororities that allow only women will not be in violation of Title IX. But the present day question is: Does gender identity fall under the umbrella of "sex"? For now, as it relates to Title IX, the answer is yes.
