When parents divorce, they sometimes have questions about which parent has rights in special education. The federal Individuals with Disabilities Education Act (IDEA) and Minnesota state special education laws and regulations clearly describe parental rights and the school district's duty to meet them. Most rights are unchanged by divorce. The divorce decree or the parenting plan (legal documents describing individual parent's obligations after the marriage ends) is where the relationship among the parents, their child, and the education system should be clearly defined. Minnesota law gives full rights in decision making to either parent in special education unless the school district is "provided with evidence that there is a court order, state statute, or legally binding instrument that specifically revokes these rights." Specific questions and answers are provided for divorced parents of children in special education programs in Minnesota. Some of the topics covered include: (1) Which parent can make special education decisions; (2) How legal and physical custody affect decisions about school; (3) Who can give consent when a child receives special education; and (4) What happens when divorced parents have joint physical custody and live in different school districts.
