State Your Claim!
Thypin, Marilyn; Glasner, Lynne
A short fictional work for limited English speakers relates a young couple's experience in learning about small claims court through an incident involving damage to the husband's leather jacket. The damage to the jacket occurred when it was left at a dry clearner, but the dry cleaner claims that it sent the jacket to a special cleaner that handles leather clothes. The husband goes to the small claims court and learns how to file a complaint using the proper legal name of the dry cleaners. At the hearing, the husband presents the case to the judge and shows the evidence of damage. The cleaner claims that the damage was done by the special cleaners where the jacket was sent. The judge orders the defendant to pay for about three-quarters of the original price of the jacket, the cost of the cleaning, and the fee for filing the claim to the court. When the cleaner fails to repay the husband within the specified time period, the husband learns that he will have to pay a fee to have the sheriff enforce the court order. He decides to go to the cleaner rather than the sheriff and is paid by the cleaner, who asks for his assistance when she sues the other cleaner who damaged the jacket. Photographs illustrate the story. (SW)
