The New Member on the Court: Potential Effect on School Law Decisions.

An analysis is made of the voting record of Justice Sandra Day O'Connor on cases related to education and the impact of these votes. The decisions of the Supreme Court during the 1981-82 term were classified under one of seven different headings: (1) religion and the schools; (2) freedom of expression; (3) due process of law; (4) racial segregation; (5) racial discrimination; (6) sexual discrimination; and (7) other equal opportunity and civil rights cases. Full opinions were written this term on 143 cases. After analysis of 24 cases in the above classifications, the author concludes that Justice O'Connor voted with the most conservative members of the Court; is a champion of states' rights; and is a firm believer in the elimination of sexual discrimination in those areas supported by public funds.
