The British North America Act of 1867, the founding constitution of Canada, provides that all matters pertaining to Indians and Indian lands are under Federal jurisdiction. Because of this, the province of British Columbia (BC) has not felt it could do much for native peoples and little attention has been paid to the extension of provincial services to them. However, in 1949 the Elections Act of the province was amended to extend the right to vote to Indians living on reserves. Also in 1949, the BC Public Schools Act was changed to allow local school boards to accept Federal funds for the joint education of Indian children in the ordinary provincial school system. At this time, the BC provincial government realized it knew little about reserve Indians. It therefore set up the Indian Enquiry Act for government consideration. Also, because of these past differences of jurisdiction under the Indian Act and provincial statutes, BC Indians have many long-standing grievances that need to be examined. Areas under investigation are: (1) Indian languages; (2) school trustees; (3) school districts; (4) The Native Courtworker and Counselling Association of British Columbia; (5) municipal affairs; and (6) general issues, such as arts and crafts programs, provincial taxation of leased Indian lands, and mineral rights on Indian reserves.
