The Testing of Teachers: Legal Parameters and Procedures.

This chapter is limited to the specific employment practice of employee testing. The purpose is to distinguish between constitutional and statutory standards for challenging discriminatory testing practices and to propose procedures for developing, administering, and using tests as part of personnel decisions. Four Supreme Court cases are summarized that involved constitutional and statutory standards. Based on these case law precedents and related Equal Employment Opportunity Commission guidelines, procedures for validating tests to help in the selection of teachers have been developed. The procedures suggested are presented in a 12-step simplified format. (MLF)
