Parent Association of Andrew Jackson School etc., et al. v. Ambach, Commissioner of Education of the State of New York, et al., United States Court of Appeals for the Second Circuit, Nos. 362, 365-5--August Term, 1978. Docket Nos. 78-7274, 78-7307, 78-7308.
Court of Appeals. Second Circuit.
This is the text of a United States Court of Appeals decision setting aside the order of a lower court to desegregate a New York City high school. The Court found that the segregation of the school was de facto, not de jure segregation, and that Federal judges are not authorized to impose a school desegregation plan where there has been no constitutional transgression. The Court also ordered that the lower court injunction against the continued operation of a school assignment plan be remanded to the District Court for further findings. (WP)
