Homosexuality, the Law, and Public Schools.

This paper discusses the current issues of homosexuality, the law, and public schools. It states that school administrators need to understand homosexuality as a concept and as a legal issue because research on homosexuality has historically been remiss and court cases regarding the rights of homosexuals are increasing. Following a brief summary of the origins of writings on homosexuality, the document reviews court cases within the past 10 years that deal with the hiring, dismissal, or failure to renew contracts of homosexual teachers. Major implications listed for the future regarding homosexuality and public schools are (1) the views of society and the rulings of courts will continue to become more accepting of the rights of homosexuals, (2) upgrading the knowledge of educators regarding homosexuality will become necessary, (3) court litigation will increase involving homosexuals and public schools, and (4) litigation on homosexuality should be reviewed in graduate courses on school law.
